On 26 June 2015 received notice from USCG NVDC that application for COD was rejected again. At issue was they stated the Bill of Sale provided was "ineligible for recording because it was not properly acknowledged" (notarized). They then stated to resubmit another bill of sale that was properly acknowledged before a US notary.

      This latest rejection letter statements were illogical since the submitted Bill of Sale was legally notarized in Ireland.  Also the "new" requirement that it must be properly acknowledged before a US notary did not make sense due to the fact this was a foreign purchase.  I suspected something was wrong with the advice of NVDC personnel.

      First action was a complete review of 46 CFR 67 requirements.  Next, I called the NVDC.

      This conversation revealed that Indra's Bill of Sale, legally notarized in Ireland with a Garda Síochána stamp reflecting this, was not accepted since the person performing the review was unknowledgeable of foreign notaries. The advice to obtain an acknowledgement before a US notary for a foreign sale was also deemed incorrect.

      Next we discussed the original AMSA Form 159 Bill of Sale submitted, that was legally accepted and recorded by the AMSA Shipping Registration Office. The issue here was even though it was witnessed and signed by a separate person this did not satisfy the USCG requirement for a notary [46 CFR 67.207.a.2]. Note: A notary is refereed to as an acknowledgment in the CFR.

      Next asked about the requirement for a Apostille [46 CFR 67.3 Acknowledgment (2)] for any foreign notary, which based on the long silence and mumbled discussions in the background, I knew they were not well versed in this subject.  Finally they came back online and stated if the AMSA Form 159 Bill of Sale was Apostille (Hague Convention Abolishing the Requirement for Legalization of Public Documents, 1961) they "probably" could accept it.  I emphasized to them that by international treaty, which the US was party to, that an Apostille document MUST be accepted and is stipulated to carry the same legality of its foreign country.

      I explained to them it was not practical to re-initiate another AMSA Form 159 Bill of Sale with an Australian notary as the previous owner was now in Ireland with no future projected date to return to Australia.  They already had a copy of the original legally recorded Australian Bill of Sale, whether they accepted it or not.  They then suggested that I also apply for a waiver for bill of sale requirements [46 CFR 67.89].  The cost of the long distance phone call was approximately $32.00.

      So the next course of action was to get certified copies of AMSA Form 159 Bill of Sale and the Certificate of Deletion from the AMSA Shipping Registration Office and have these documents Apostille by the Australian Department of Foreign Affairs.

       The installation concept for a public address (PA) hailer or speaker entails a speaker connected with two wires to a capable radio. We choose the location for the PA hailer to be under the radar dome mounted on the main mast at about a height of 21 feet. How to mount the speaker at that location we were not sure of. The wires were to be run internal to the mast and have a connection point at the mast base, internal to the boat, to allow the wires to be easily disconnected for mast removal. A separate two wire run would be installed from the internal connection point below the mast base to a radio located a the navigation desk.

      We had already selected an Icom IC-M424G-21 Fixed Mount VHF Radio with GPS to replace Indra's old VHF radio. We had downloaded the Icom IC-M424G-21 VHF Radio manual and it stated for the PA hailer: "Connect a PA speaker rated at more than 10 W at 10% distortion with a 4 ohm load." We selected a Newmar PA-8W Deck Hailer Horn rated at 8 W nominal 12 W peak with a 8 ohm impedance; and because it had a small physical size.

          On 29 March 2015 we ordered a Newmar PA-8W Deck Hailer Horn from Defender's website at a cost of $14.39. This item was shipped to our balikbayan box consolidator and forwarder Manila Forwarder in Los Angles, California and received there on 17 April 2015. We received this item in Naga City, Cebu on 23 June 2015.

          A Blue Sea 2506 30 Ampere 6 Circuit Terminal Block at a cost of $6.62, a 100-foot roll of 16/2 AWG Duplex Tinned Marine Wire at a cost of $33.50, and eight electrical terminals at a estimated cost of $0.25 each were ordered and received separately.

          Next step is to determine when to install this.

          We had been tracking the status of our ocean freight shipment of five Balikbayan boxes and we knew they had already been delivered to the warehouse in Cebu City. We received a cell phone text message early this morning from the delivery driver asking for clarification of where we were specifically located in Naga City, Cebu. We gave them visual markers to identify our house and said we would be standing outside to let them in our gate.  Just prior to 07:30am they arrived and unloaded the boxes.  It took 47 days from time of shipment notification in Los Angles, California to arrive at our door step - not to bad. Now the fun part begins - opening all the boxes and verify the shipment is complete.

          I rechecked the submitted USCG CG-1340 Bill of Sale and had no issues reading each and every word. Using a PDF program we converted the USCG CG-1340 Bill of Sale from a color to a black/white copy; it was not perfect but more clear.

          On 20 June 2015 resubmitted application to the USCG NVDC.

            On 19 June 2015 received notice from USCG NVDC that the application for Indra's COD was rejected again. At issue was they stated the USCG CG-1340 Bill of Sale provided was "illegible and could not be read".

              On 29 May 2015 we forwarded by email another AMSA Form 159 Bill of Sale and USCG CG-1340 Bill of Sale and asked Margie Jesson to sign them and have them notarized. We received the following email from her.

              I am currently in England and fly to Ireland tomorrow. I do not return to New Zealand till November. I can get a certified copy of the documents done in Ireland if that is acceptable to USCG. Here is a list of the people allowed to certify (notarize) documents in Ireland. I would use a policeman (Garda) or Bank offcial to do it.

              What is meant by a certified copy of a document?

              Certification of copies of original documents must be carried out by one of the following:

              • Garda Síochána
              • Chartered & Certified Public Accountant
              • Notaries Public/Practising Solicitor
              • Embassy/Consular Staff
              • Commissioner for Oaths
              • Bank or Building Society Official

              The person providing the certification should complete the following on the copy:

              • Confirm that it is a true copy of the original document.
              • Clearly state, in capital letters, his/her name, position, address and telephone number of the company/firm/practice or employer for whom they work.
              • Sign, date and preferably stamp the document with their official stamp.

               

              On 16 June 2015, she sent email with the Bill of Sale signed and legally notarized by Ireland requirements - a Irish police officer (Garda Síochána) can legally perform a notary there.

              On 18 June 2015 resubmitted Indra's COD application to USCG NVDC.
